Psilocybin Smartshops

The Netherlands is one of the few countries where psilocybin truffles (sclerotia) are legally sold in licensed smartshops. Magic mushrooms themselves were banned in 2008, but truffles remain legal. Smartshops are regulated and must follow strict guidelines.

Canada operates in a legal grey area for psilocybin. While technically illegal under the CDSA, enforcement is minimal in cities like Vancouver and Toronto where mushroom dispensaries operate openly. Some exemptions exist for therapeutic use.

Psilocybin legality varies by state and city in the US. Oregon has legalized psilocybin therapy services (Measure 109). Cities like Denver, Oakland, and Washington DC have decriminalized possession. Most states still classify psilocybin as Schedule I.

Jamaica has no specific laws prohibiting psilocybin mushrooms. They grow naturally on the island and are openly sold to tourists and locals alike.

Portugal decriminalized personal use of all drugs in 2001. While sale remains illegal, possession of small amounts for personal use is treated as an administrative offense rather than criminal.

The Czech Republic has relatively liberal drug policies. Possession of small amounts of psilocybin mushrooms is decriminalized (a misdemeanor). Smartshops sell legal alternatives and some operate in grey areas.

Brazil has a growing mycology scene. While psilocybin is controlled, enforcement is inconsistent. Online shops sell spores and grow kits, often marketed for research purposes.

Australia approved psilocybin for therapeutic use by authorized psychiatrists in July 2023. Recreational use remains illegal. Smartshops focus on legal herbs and functional mushrooms.
