What federal "legal" actually means

Amanita muscaria is not on the US Controlled Substances Act schedules. The DEA has no enforcement authority over it. This is the same federal status as kratom, kava, and Lion's Mane — all legal at the federal level, all regulated by state law.

Federal legality is not the same as FDA approval. FDA has not approved amanita muscaria as a food, dietary supplement, or drug. Commercial amanita products occupy a regulatory gray zone: legally sold under state supplement or novel-food statutes, but not FDA-endorsed for any specific use. Brands cannot make medicinal claims without triggering FDA enforcement.

The one state to watch: Louisiana

Louisiana Revised Statutes 40:989.1 explicitly prohibits amanita muscaria and amanita pantherina for human consumption. This is the only outright state-level ban as of April 2026. Shipping amanita products to Louisiana addresses is a legal risk — most vendors geo-block LA at checkout.

The five restricted states

Alaska and Tennessee: 21+ age gate. Tennessee additionally requires vendor registration. Gummies, chocolate, and other formats legal at retail.
