On September 6, 2022 the Board of Supervisors unanimously adopted Resolution 379-22, sponsored by Supervisors Dean Preston and Hillary Ronen, urging city law enforcement to make the investigation and arrest of adults involved with entheogenic plants and fungi among its lowest priorities. It is a non-binding resolution rather than an ordinance, and it does not change state law: California Health and Safety Code section 11377 still makes possession of psilocybin a misdemeanor; cultivating spores or mycelium with intent to produce it (section 11390) is punishable by up to a year in county jail or a state prison term; and selling or transporting it for sale (section 11379) is a felony. California licenses no psilocybin retailers, service centers, or healing centers, so no San Francisco storefront, delivery service, or church holds any lawful authority to sell psilocybin.

San Francisco has no tolerated legal psilocybin retail of the kind seen in Vancouver or Amsterdam, but the deprioritization resolution is widely misread as permission, and unlicensed operators — delivery services, membership 'entheogen churches' claiming a religious exemption, and smoke shops stocking so-called mushroom chocolate bars — trade on that confusion. None of them are licensed, because California issues no licenses; the resolution binds no prosecutor and offers buyers and sellers no legal protection, and religious-use claims have not been upheld for retail psilocybin sales in California courts. The product risk is documented. On November 22, 2024 the California Department of Public Health warned consumers not to eat PolkaDot brand Mushroom Magic Blend chocolate bars, which were sold online and to retailers such as smoke shops: the bars were labeled as containing amanita muscaria — itself an unapproved food additive — and laboratory testing found they also contained a synthetic psychoactive drug, after which more than $3 million worth were embargoed and voluntarily destroyed. On December 11, 2025 CDPH issued a comparable warning about TRE House brand 'magic mushroom' gummies, chocolate bars, and syrup, labeled as a 'Magic Mushroom Microdose Blend' but found to contain 4-Acetoxy-DET and, in most products, 4-Acetoxy-DMT — synthetic analogues of psilocin. In neither case did the label match the contents. Anything sold this way is unregulated and untested, and what is on the label frequently is not what is in the bar.

California is one of only four states that criminalize psilocybin spores — alongside Georgia, Idaho, and, since July 2025, Florida — because Health and Safety Code section 11391 bars selling, importing, or transporting them to facilitate cultivation, so the mail-order spore option available in most states does not apply in San Francisco and reputable vendors will not ship here. What is lawful to buy locally is functional (non-psychoactive) mushroom products such as lion's mane, reishi, turkey tail, and cordyceps, plus amanita muscaria products, which are unscheduled but genuinely toxic and which the FDA declared on December 18, 2024 to be unapproved food additives that are not Generally Recognized As Safe. The only supervised psilocybin legally available in the city is through clinical trials at UCSF's Translational Psychedelic Research (TrPR) Program, which was still listing a psilocybin study for depression in Parkinson's disease (adults 40-80) as recruiting in 2026; the nearest licensed paid access is at Oregon's licensed psilocybin service centers or Colorado's licensed healing centers, both open to adults 21+ regardless of residency.
